why is my phone unlocked?

About 5 months ago i bought a k800i from o2. only a month before the phone had been anounced not availible and was last one in stock in any o2 store in the country.
the phone arrived at the shop 2 weeks before I bought it, which was 2 weeks after "out of date" and had added software. A year before this I bought the same phone, but it had less media than the new one. (I sadly lost the other one) I then recently realised the phone was unlocked as my mate was mucking about putting his TESCO mobile sim in and it worked. because the phone was not availible to make, does that mean that o2 coluldnt lock it?

it just means its has been factory refirb phone at some point

I think it's not locked because they don't lock them - in any event, there is no <simlock> section in the customize.xml:

The only locked O2 phones I've seen recently are pre-pay ones or the ones that are O2 specific models (like the XDAs).

If your previous phone had less media it's possible that they were playing with it in the shop and then did a master reset on it -O2 tend not to lock their preloaded stuff so you can delete it if you don't want it:
